This Privacy Policy (“Policy”) governs the collection, use, monitoring, and retention of information by Quantalytix, Inc. (“Quantalytix,” “we,” “our,” or “us”) as it relates to your access to and use of the Quantalytix Microsoft Excel Plugin and any related systems, APIs, data services, or interfaces (collectively, the “Services”).By installing, accessing, or using the Services, you expressly acknowledge and consent to this Policy. If you do not agree with this Policy, you must immediately cease all use of the Services.

1. Scope and Applicability

This Policy applies to all users, including but not limited to employees, agents, or contractors of financial institutions or other organizations that have licensed Quantalytix’s products. The Services may process confidential, financial, and banking data, which may be subject to regulatory oversight (including, but not limited to, the Gramm-Leach-Bliley Act (GLBA), FFIEC guidance, and other federal or state privacy laws).

Your employer or institution’s separate privacy or data-use policies may also apply. You remain independently responsible for ensuring compliance with any obligations owed to your employer, clients, or applicable regulatory authorities.

2. No Expectation of Privacy

By using the Services, you acknowledge and agree that:

  • You have no reasonable expectation of privacy with respect to any actions, data, communications, or information transmitted to, through, or stored within the Services.
  • Quantalytix may monitor, log, audit, record, and review any and all activity within the Services, including metadata, timestamps, and content, for security, compliance, operational, or investigative purposes.
  • Quantalytix reserves the right to disclose activity records to your employer, regulators, law enforcement, or other authorized parties where required or permitted by law.
  • Such monitoring may occur without additional notice and may include both automated and manual processes.

3. Information We Collect

Quantalytix may collect and retain the following categories of information, including but not limited to:

  • User Identifiers: Names, usernames, email addresses, IP addresses, machine identifiers, and organization affiliation.
  • Usage Activity: Command logs, spreadsheet interaction metadata, formula executions, plug-in feature usage, timestamps, and error reports.
  • Device and Environment Data: Operating system details, Excel version, and network telemetry.
  • Content and Data Submissions: Any information uploaded, transmitted, or accessed through the Plugin, including financial or banking data associated with your institution.
  • Authentication and Security Data: Tokens, session identifiers, and related credentials.

4. Purpose of Collection and Use

We collect and use information to:

  • Operate, secure, and maintain the Services.
  • Detect, prevent, and investigate unauthorized access, fraud, or misuse.
  • Comply with applicable legal, regulatory, and contractual obligations.
  • Improve performance, analytics, and functionality of our software.
  • Support audits, legal claims, and compliance reviews.

5. Data Retention and Storage

Quantalytix may retain all collected information for as long as deemed necessary for legitimate business, legal, regulatory, or security purposes. This may include indefinite retention of audit logs or activity records to comply with applicable laws or internal compliance policies.

Data may be stored in the United States or other jurisdictions with appropriate security controls. By using the Services, you consent to such data storage, transfer, and processing.

6. Monitoring, Logging, and Auditing

You understand and agree that:

  • Quantalytix may actively monitor and record all system interactions, including file access, commands issued, and data retrieved.
  • Such monitoring may be continuous, automated, or conducted retroactively for forensic or compliance review.
  • Quantalytix may provide reports or access logs to your employer or regulatory bodies as necessary or as required by law.

7. Employer and Institutional Responsibility

Your use of the Services is subject to your employer’s or institution’s internal privacy, data handling, and access control policies. Quantalytix is not responsible for any internal misuse or disclosure of data by your employer or its personnel.

By using the Services, you affirm that your use is authorized by your organization and that your organization has provided any required notices or consents to applicable data subjects.

8. Disclosure of Information

Quantalytix may disclose information:

  • To your employer or organization’s designated administrators.
  • To governmental, regulatory, or law enforcement authorities upon lawful request.
  • To legal counsel, auditors, or service providers bound by confidentiality agreements.
  • In connection with mergers, acquisitions, or corporate restructuring.

Quantalytix will not sell or lease your personal information to third parties for marketing purposes.

9. Legal Compliance and Limitation of Liability

Quantalytix complies with applicable privacy and security laws but disclaims all warranties, express or implied, regarding the confidentiality or security of user activity.

To the fullest extent permitted by law:

  • Quantalytix shall not be liable for any damages arising from monitoring, data retention, disclosure, or lawful access to user data.
  • You agree to indemnify and hold Quantalytix harmless from any claims, losses, or liabilities resulting from your use of the Services, including violations of privacy or data-handling obligations owed to your employer or third parties.

10. Security Measures

Quantalytix employs industry-standard administrative, technical, and physical safeguards to protect data; however, no system is guaranteed secure. By using the Services, you acknowledge and accept these inherent risks.

11. Data Subject Rights

Certain jurisdictions may provide limited rights to access, correct, or delete personal data. Quantalytix will comply with such requests only where required by law and may deny requests inconsistent with operational, legal, or regulatory retention requirements.

12. Changes to This Policy

Quantalytix may update or modify this Policy at any time without prior notice. The revised version will be effective upon posting. Continued use of the Services constitutes your acceptance of the updated terms.
